1. Acceptance of Terms

By accessing or using SBOMVault.ai ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

SBOMVault.ai is a Software Bill of Materials (SBOM) management platform that provides SBOM ingestion, vulnerability analysis, compliance checking, and secure sharing capabilities. The Service is provided on a subscription basis with tiered plans.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your account.

4. Acceptable Use

You agree not to:

Use the Service for any unlawful purpose
Upload malicious files or content designed to harm the platform or other users
Attempt to gain unauthorized access to any part of the Service
Resell or redistribute the Service without written authorization
Use the Service to infringe the intellectual property rights of others

5. Your Data

You retain ownership of all SBOM files and data you upload to the Service. By uploading content, you grant SBOMVault.ai a limited license to process and store that content solely for the purpose of providing the Service to you. We do not claim ownership of your data and will not use it for any other purpose.

Retention requires an active subscription. We store your SBOMs, scan results, and associated data only while you maintain an active subscription at a plan level that covers them. If you cancel, downgrade below the level required to store your data, or your account is suspended or terminated (including for non-payment), we are under no obligation to retain your SBOMs and may delete them after the 30-day export window described in Section 11. Stated audit-log retention periods apply only while your subscription remains active. If you need to keep your data, export it before cancelling or downgrading.

6. Subscription and Billing

Paid plans are billed in advance on a monthly or annual basis and renew automatically at the end of each billing period at the then-current rate for your plan, until you cancel. You can cancel at any time from Settings → Billing → Manage Subscription; cancellation takes effect at the end of the current billing period and you retain access until then. Plan upgrades take effect immediately and the prorated difference is charged at the time of the change. All fees are non-refundable except as required by law. We reserve the right to change pricing with 30 days notice; price changes apply from your next renewal. Failure to pay may result in suspension or termination of your account. Add-on capacity packs are billed with your subscription on the same billing interval and prorate immediately when added or removed. Where a plan feature is described as "unlimited," it is subject to fair use: usage consistent with the ordinary operation of a single organization of your size. We may throttle or discuss commercial terms for usage that materially exceeds that, and will contact you before taking any action.

7. Free Tier

The free Starter plan is provided as-is with no uptime guarantees. We reserve the right to modify or discontinue the free tier at any time with reasonable notice.

8. Intellectual Property

The SBOMVault.ai platform, including its design, code, and content, is owned by SBOMVault.ai and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without written permission.

9. Disclaimers

The Service is provided "as is" without warranties of any kind. Vulnerability data and compliance results are provided for informational purposes only and should not be relied upon as the sole basis for security decisions. SBOMVault.ai does not guarantee that all vulnerabilities will be detected.

10. Limitation of Liability

To the maximum extent permitted by law, SBOMVault.ai shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service, even if advised of the possibility of such damages.

11. Termination

Either party may terminate your account at any time. Upon termination, your right to use the Service will immediately cease. We will provide you with a data export upon request within 30 days of termination.

12. Changes to Terms

We may update these Terms from time to time. Continued use of the Service after changes constitutes acceptance of the new Terms. We will notify you of material changes via email.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.
